CCPA Privacy Notice
 
The California Code of Regulations defines a "resident" as:
 
(1) every individual who is in the state of California for other than a temporary or transitory purpose and
(2) every individual who is domiciled in the state of California who is outside the state of California for a temporary or transitory purpose
 
All other individuals are defined as "non-residents."

Will your information be shared with anyone else?
 
We may disclose your personal information with our service providers pursuant to a written contract between us and each service provider. Each service provider is a for-profit entity that processes the information on our behalf.
 
We may use your personal information for our own business purposes, such as for undertaking internal research for technological development and demonstration. This is not considered to be "selling" of your personal data.

Swiss Made Brands USA Inc has not sold any personal information to third parties for a business or commercial purpose in the preceding twelve (12) months. Swiss Made Brands USA Inc will not sell personal information in the future belonging to website visitors, users and other consumers.
 
Your rights with respect to your personal data
 
Right to Request Deletion of the Data - Request to Delete
 
You can ask for the deletion of your personal information. If you ask us to delete your personal information, we will respect your request and delete your personal information, subject to certain exceptions provided by law, such as (but not limited to) the exercise by another consumer of his or her right to free speech, our compliance requirements resulting from a legal obligation or any processing that may be required to protect against illegal activities.

Depending on the circumstances, you have a right to know:

Verification Process
 
Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g. phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate.
 
We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. If, however, we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity, and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.
 
Other Privacy Rights
 
  • you may object to the processing of your personal data
 
  • you may request correction of your personal data if it is incorrect or no longer relevant, or ask to restrict the processing of the data
 
  • you can designate an authorized agent to make a request under the CCPA on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with the CCPA.
 
  • you may request to opt-out from future selling of your personal information to third parties. Upon receiving a request to opt-out, we will act upon the request as soon as feasibly possible, but no later than 15 days from the date of the request submission.

Mobile Terms of Service

The Swiss Diamond mobile message service (the "Service") is operated by Swiss Diamond (“Swiss Diamond”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Swiss Diamond’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Swiss Diamond through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Swiss Diamond. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18333196289 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Swiss Diamond mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

 Website Partners and 3rd Party Functions

1. Rakuten

We partner with Rakuten Marketing, who may collect personal information when you interact with our site. The collection and use of this information is subject to the privacy policy located here:

2. Olark (Customer Service Chat)

We partner with Olark for our online customer Service Chat.  Olark  may collect personal information when you interact with our site.  We require expressed consent to chat with our customer service team and redact all information 1 day (24 hours) after the chat has ended. 

What does Olark redact? When Olark redacts visitor information from a transcript, we destroy all form submissions (e.g., responses to pre-chat name, email, and phone fields); all text that is formatted as an email address, phone number, IP address and the visitor’s internal ID. This information is replaced with 'redacted' in the transcript . We also destroy all visitor files uploaded through the chat box. Redaction is not reversible.
