These Terms of Service ("Terms") govern your use of swissdiamond.com (the "Site") and any purchase you make from it. The Site is operated by Swiss Made Brands USA Inc ("Swiss Diamond," "we," "us" or "our"). By using the Site or placing an order, you agree to these Terms, our Privacy Policy, Refund Policy and Shipping Policy. If you do not agree, please do not use the Site.
1. Eligibility and accounts
You must be at least the age of majority where you live to place an order. If you create an account, you are responsible for keeping your login details secure and for activity under your account.
2. Products and product information
We try to describe and display our products accurately. Colors, dimensions and weights may vary slightly from what is shown. Product availability can change without notice, and we may limit quantities.
3. Prices and payment
Prices are in U.S. dollars and may change without notice. If a product is listed at an incorrect price or with incorrect information because of an error, we may cancel any order for that product, even after it is confirmed, and refund any amount charged. You agree to provide current, complete and accurate payment and contact information.
4. Orders
Your order is an offer to buy. We may decline or cancel an order, for example if an item is unavailable, a pricing error occurs, or we suspect fraud. We may contact you to verify an order before it ships, as described in our Shipping Policy.
5. Shipping and state restrictions
Shipping terms are set out in our Shipping Policy. Some products cannot be shipped to certain states; any restriction is shown on the product page. Title and risk of loss pass to you when the carrier delivers your order.
6. Returns and warranty
Returns are governed by our Refund Policy. Our limited lifetime warranty covers manufacturing defects only, subject to its terms and exclusions; see Warranty Information. Please follow the Use & Care Instructions included with your product.
7. Promotions
Discount codes and promotions are subject to the terms stated with them, may not be combined unless stated, and may end at any time. Sweepstakes and giveaways are governed by their own official rules.
8. Intellectual property
All content on the Site, including text, images, logos and trademarks, belongs to Swiss Diamond or its licensors. You may not copy, reproduce or use it for commercial purposes without our written permission.
9. Reviews and submissions
If you submit a review, comment or other content, you confirm it is your own honest opinion and does not violate anyone's rights. You grant us a non-exclusive, royalty-free license to use, display and reproduce it in connection with the Site and our marketing. We may remove content at our discretion.
10. Prohibited uses
You may not use the Site for any unlawful purpose, to interfere with its security or operation, to scrape or harvest data, or to purchase products for unauthorized resale.
11. Third-party links and services
The Site may link to or use third-party services, such as payment providers. We are not responsible for third-party sites or services, which are governed by their own terms.
12. Disclaimer
Except as expressly stated in our limited warranty, the Site and products are provided "as is" and "as available," to the fullest extent permitted by law.
13. Limitation of liability
To the fullest extent permitted by law, Swiss Diamond will not be liable for indirect, incidental, special or consequential damages arising from your use of the Site or products, and our total liability for any claim will not exceed the amount you paid for the product involved. Some jurisdictions do not allow these limitations, so they may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless Swiss Diamond and its affiliates from claims arising from your breach of these Terms or misuse of the Site.
15. Governing law
These Terms are governed by the laws of North Carolina, without regard to conflict-of-law rules.
16. Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted, and the "Last updated" date will change. Orders placed before a change are governed by the Terms in effect when the order was placed.
